This privacy policy ("Privacy Policy") has been drafted and published in accordance with the Information Technology Act, 2000, the Information Technology (Amendment) Act, 2008, and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, of the Republic of India.

MP Birla Group ("MP Birla Group”, “We", “Us “or “Our”) respects the privacy of our users (“User” or “You”).

This Privacy Policy informs you of our policies regarding the collection, use, storage, processing, disclosure and protection of any information, including, but not limited to, business, personal information  provided by You while using our mobile application (the “Application”) and the choices you have associated with that information. By using the Application, you hereby accord your acceptance and agree to abide by the terms and conditions in respect of the collection and use of information in accordance with this Privacy Policy.

We must receive and collect some information to operate, provide, improve, understand, support and market our Products through the Application. We require certain information to deliver our services and without this we shall not be able to provide the services to you. We at MP Birla Group, respect the privacy of everyone who avails our Application and are committed to maintaining the privacy and security of their personal information.

Our services provided through this Application is optional, if used by you, require us to collect additional information to provide such services. You will be notified of such collection as appropriate. If you choose not to provide the information needed to use our services you will be unable to use the services.

All rights associated with this Application are reserved by us. The content, code and applications associated with this Application as well as other Applications associated with this Application are copyright protected. Application users may not reproduce, copy, or redistribute content or code in any form without written permission from the MP Birla Group, except for personal use.

This policy constitutes a legal agreement between You, as the user of the Application, and MP Birla Group, as the owner of the Application. You must be a natural person who is at least 18 years of age.

By installing and/or accessing the Application and voluntarily providing us with information (personal and/ or non- personal), Your use of this Application constitutes your acceptance to this Privacy Policy and consenting to Our use of such information in accordance with this Privicy Policy. This Privicy Policy describes how we collect, use and share information provided through this Application. This Privacy Policy does not apply to third-party Applications/ applications that are connected via links to this Application. If You do not agree with the terms and conditions of this Privacy Policy, please do not proceed further to use and access this Application.

Your use of the Application will be governed by this Privacy Policy as applicable to the Application together with all policies, notices, guidelines, disclaimers, terms and conditions that are published, updated and revised from time to time which are incorporated herein including but not limited to the Dealership Agreement and such other terms as may be applicable to You in Your capacity as a user of the Application. This Privacy Policy shall be enforceable against You in the same manner as any other written agreement.

We may update this Privacy Policy from time to time. You must periodically review the Privacy Policy for the latest information on our privacy practices prior to sharing of information or use of the Application hereof.

PURPOSE

The purpose of this policy is to ensure that your information provided by you is used, processed, disclosed and stored in accordance with the applicable laws. The information stored in such manner shall be protected by the MP Birla Group in accordance with the terms and conditions set out in this Privacy Policy.

INFORMATION WE COLLECT

During your use of this Application We may collect and process such information from You, including but not limited to the information mentioned below:

1. Personal Information: This includes the information that can be used to uniquely identify or contact you. In order to facilitate You to use our Application, We may collect a variety of Personal Information, including but not limited to, Your name, postal address, phone number, email address, government issued identification cards, etc.and any other basic information to create an account.

We may collect any other information that We are required to collect as per specific mandate from any bank, payment gateway or as required under applicable law.

The Personal Information is collected from you in a voluntary fashion when You provide your credentials on the Application. You may choose not to provide such Personal Information to Us. However, it is clarified that Personal Information may also contain any chats, texts, videos, audios, files and/or share screen facilities which are used or shared by You, either alone or in conjunction with any other user of the Application and any such chats, texts, videos, audios, files and/or share screen facilities may be recorded and/or stored by the Application.

You are required to ensure that the information provided by You are accurate, complete and up to date by logging into Your account. We shall also provide You with the opportunity to update and/or edit any data relating to Your Personal Information if the same is inaccurate . Further, We may decline to process requests which We find to be contrary to the terms laid down under this Privacy Policy, the Dealership Agreement or any applicable laws, or which require disproportionate technical effort, jeopardize the privacy of others or are extremely impractical.

Please be informed that any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of this Privacy Policy.

2. Non-Personal Information: Non-Personal Information is any information that does not reveal Your specific identity, such as, browser information, information collected through Cookies (as defined below), pixel tags and other technologies, location information, etc. As is true with most websites or applications, Our Application gathers some information automatically when You visit the Application and stores it in log files. When You use the Application, We may collect certain information about Your device to facilitate, evaluate and verify Your use of the Application. This information is generally collected in aggregate form, without identifying any user individually.

1. Review the information provided by You in Your application in order to ascertain Your eligibility for using and participating in the Application.

2. To create Your Account and to support You with any applications related to Your Account.

3. Assess Your credentials as specified in Your application for accessing and availing our Application.

4. To conduct any background checks, if required, as the MP Birla Group may deem fit.

5. To update You about the status of Your application and provide You any agreed assistance or support with respect to the Application.

6. To verify whether you are entitled to access and use the Application or any products and Applications made available through the Application.

7. To provide any value-added Applications, either through itself or through a third party Application provider in the Application.

8. To prevent any abuse, trolling or other acts which may be contrary to law or detrimental to the interest of any other user of the Application or person.

9. To prevent, as far as practicable, any illegal or unlawful and/or any misuse of the Application by You .

10. To update You upon the development and news in relation to the Application.

11. Provide You updates for any events conducted by the MP Birla Group .

12. Conduct research and analysis to detect, prevent, mitigate and investigate fraudulent or illegal activities on the Application.

13. Analyse how the Application is used, diagnose Application or technical problems, and maintain security.

14. Monitor aggregate metrics such as total number of viewers, visitors, traffic, etc.

15. To notify You regarding your account, to troubleshoot problems with Your account, to resolve a dispute, to confirm Your identity in order to ensure that You are eligible to use the Application.

16. For advertising and marketing communications. We may also share Non-Personal Information with third parties such as, Our advertisers, sponsors, investors, advisors, business partners. 

17. To carry out Our obligations and to process transactions arising from any contracts entered into between You and Us and/or You and any other user of the Application.

18. To notify You about changes on the Application.

19. Notify You, if possible, in the event We become aware of any breach of the security of Your information and take appropriate action to the best of Our ability to remedy such a breach .

20. To enable Us to comply with legal and regulatory obligations.

We will use and retain Your information for such periods as necessary to comply with Our legal obligations, resolve disputes, and enforce Our agreements.

INFORMATION SECURITY

1. We use reasonable safeguards to protect and preserve the integrity and security of Your information against unauthorized access, loss, theft, unauthorised, reproduction, use or amendment, disclosure or destruction of information We hold. We encrypt Our Applications using secure server software, which is the industry standard as available today for secure transactions. We use reasonable security practices and procedures and use secure servers as mandated under applicable laws for the protection of Your information. We review Our information collection, storage and processing practices, including physical security measures to guard against unauthorized access to systems from time to time.

2. We limit the disclosure of Personal Information to Our employees, independent contractors including vendors, affiliates, consultants, business associates and Application providers , on a “need-to-know” basis, and only if the disclosure will enable that entity to provide Us with business, professional, or technical support or fulfil Your request. However, We are not responsible for any breach of security or for any actions of any third parties that receive Your Personal Information. We are also not liable for any voluntary disclosure of Personal Information by You to any other user of the Application or any other person who You have contacted through the Application.

3. As a registered user with an Account, You are responsible for keeping Your password, including one time passwords sent to You, confidential. By submitting Your information on Our Application, You agree to the handling of Your information by the MP Birla Group in a manner as stated under this Privacy Policy. We will take such steps as We consider reasonably necessary to ensure that Your information is treated securely and in accordance with the Privacy Policy.

4. By using the Application, You accept the inherent security implications of data transmission over the internet which cannot always be guaranteed as completely secure. Therefore, Your use of the Application will be at Your own risk.

5. Notwithstanding anything contained in this Privacy Policy or elsewhere, MP Birla Group shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below) or any act or omission attributable to You or any person claiming on Your behalf. A "Force Majeure Event" shall mean any event that is beyond Our reasonable control and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, device hacking, unauthorised access to mobile/computer/laptop/tablet, system and/or network, device crashes and/or malfunctioning, breach of security and encryption (provided beyond our reasonable control), power, electricity, network failure or unavailability of adequate power or electricity and/or network.

6. You agree and acknowledge that We shall retain all information provided by You until such time as is required by the applicable law or until it is required for Our internal use, whichever is later.

INFORMATION WE SHARE

1. MP Birla Group may disclose any information provided by You on the Application as may be deemed to be necessary or appropriate:

a. Under applicable law.

b. To law enforcement, governmental agencies, or authorized third-parties, in response to a verified request relating to a criminal investigation, alleged illegal activity or any other activity that may expose us, you, or any other stakeholder of the company to legal liability.

c. To enforce Our Dealership Agreement.

d. To protect Our operations or those of any of our affiliates.

e. To protect Our rights, privacy, safety or property, and/or that of our affiliates, You or others; and

f. To allow Us to pursue available remedies or limit the damages that We may sustain.

1. We may share Personal Information with other corporate entities and affiliates to help detect and prevent identity theft, fraud and other potentially illegal acts and to prevent abuse of Our Application. We may disclose Personal Information to our third-party providers including but not limited to those who provide products or applications such as contact information verification, payment processing, Application hosting, data analysis, infrastructure provision, IT applications, auditing and legal applications and other similar applications. In such an event, the third parties’ use of Your information will be bound, among other things, by confidentiality obligation and the Privacy Policy. We may store information in locations outside the direct control of the MP Birla Group (for instance, on servers or databases co-located with hosting providers) . Other than as described in this Privacy Policy and, where relevant, other applicable privacy policies, MP Birla Group will never provide Your Information to any third parties without Your consent, unless We believe in good faith that We are required or permitted to do so under applicable laws or to protect and defend the MP Birla Group’s rights and/or property.

2. The MP Birla Group may be involved in the transaction of a merger, acquisition, sale of assets, business re-organization, etc. During such a process, it may sell, transfer or otherwise share some or all of its assets which may include Your information. However, in such an event of sale or transfer, the MP Birla Group shall reasonably ensure that Your information collected and stored by the MP Birla Group is stored and used by the transferee in a manner that is consistent with this Privacy Policy. Any such third party to whom We transfer or sell shall have the right to continue to use the information that You provide to Us or is collected by Us immediately prior to such transfer or sale. On completion of the sale or transfer, the Privacy Policy of the third party shall apply with respect to Your information. 3. We assume no liability for any disclosure of information due to errors in transmission, unauthorised third party access or other acts of third parties, or acts or omissions beyond Our reasonable control and You agree that You will not hold Us responsible for any breach of security unless such breach has been caused as a direct result of Our gross negligence or wilful default.

Our Application may, from time to time, contain links to and from the websites of Our partner networks, affiliates and other third parties, whose privacy policy may differ from that of Ours. CHOICE/OPT-OUT/DELETION/CORRECTION

1. MP Birla Group provides all its users with the opportunity to opt-out of receiving non-essential communications from us or on behalf of our partners after setting up an Account.

2. If You want to remove Your contact information from all Our lists and newsletters, please write to us at ______________. 

3. If You wish to have the information or data that you have provided to the MP Birla Group deleted, You can always do so by sending a request to us on the e-mail id mentioned above. You may note that correction or deletion of certain information or data may lead to cancellation of your registration with the Application or your access to certain features of the Application. You also agree and acknowledge that certain data or information cannot be corrected or deleted or prohibited to be deleted as required under any applicable law, law enforcement requests or under any judicial proceedings. Any information that is sought to be deleted, whether upon deactivation of Your account on the Application or otherwise, shall be deleted from the user interface of the Application but may be retained on the servers of the MP Birla Group for such period as may be required under applicable laws or as per the policy of the MP Birla Group or any third-party vendor engaged by the MP Birla Group . You acknowledge and agree that MP Birla Group and/or any third-party vendor engaged and authorised by the MP Birla Group shall be entitled to retain such information to the extent required under this clause and the MP Birla Group disclaims any liability or obligation not specifically agreed hereunder with respect to such information. You also agree that any aggregated information or data based on the analysis or benchmarking activity undertaken by the MP Birla Group , either manually or through related algorithms, shall be the sole property of the MP Birla Group and the MP Birla Group shall neither have the obligation to delete it or provide such aggregated information or data to You.

EXCLUSION

This Privacy Policy does not apply to any information other than such information collected by the MP Birla Group through the Application. This Privacy Policy shall not apply to any unsolicited information You provide Us through this Application or through any other means. This includes, but is not limited to, information posted to any public areas of the Application. All such unsolicited information shall be deemed to be non-confidential and MP Birla Group shall be free to use, process or disclose such unsolicited information without any limitations. We make no representation that the content contained on the Application is appropriate or to be used or accessed outside of the Republic of India. The MP Birla Group’s responsibility with respect to such information shall be as per the laws of Republic of India. If You use or access the Application from outside the Republic of India, You do so at Your own risk and are responsible for compliance with the laws of such jurisdiction.

SEVERABILITY

We have taken every effort to ensure that this Privacy Policy adheres with the applicable laws. The invalidity or unenforceability of any part of this Policy shall not prejudice or affect the validity or enforceability of the remainder of this Privacy Policy.

WAIVER

Any rights or remedies under this Privacy Policies may be waived only in writing. Delay in exercising or non-exercise of any such right or remedy does not constitute a waiver of that right or remedy, or any other right or remedy.

GOVERNING LAW AND JURISDICTION

This Privacy Policy are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with the use of the Application or this Privacy Policy shall be subject to the exclusive jurisdiction of the courts in Kolkata, India.
