Terms and Conditions

Please read the following terms and conditions carefully as they explain the nature and scope of the relationship between MP Birla Cement and a Member of the Akanksha program. The terms and conditions given below are intended to protect rights for both MP Birla Cement and you as Akanksha Member. By accessing this Application on your device, you hereby accord your acceptance to be bound by these Terms and Conditions.

Definitions:

In these terms and conditions, unless the context specifies otherwise:

1.  MP Birla Cement shall mean both Birla Corporation Limited and its subsidiary company RCCPL Pvt. Ltd.

2.  ‘Akanksha’ means this MP Birla Cement program for “Technocrat(s)”, relationship and recognition initiative owned, managed and operated by MP Birla Cement, which will provide benefits, rewards and recognition to select and registered Architects/ Civil Engineers, being referred to as “Technocrats” here.

3.  'Member' shall only mean a “Architects/ Civil Engineers (Technocrats)” invited by MP Birla Cement to join the program. Such invitees must register themselves on the digital portal of the program.

4.  ‘Technocrats’ shall mean an individual who is professionally qualified and who practices Civil Engineering/ Architecture including the application of planning, designing, constructing and maintaining, building and public infrastructure while protecting the public and environmental health, as well as improving the existing infrastructure that needs renovation.

5.  ‘Year’ shall mean the period of 12 months. Program cycle shall start from the month of April of the present year to the month March next year.

6.  ‘Month’ shall mean English calendar month.

7.  ‘Benefit’ means certain rewards and facilities that are given to a member based on pre-defined criteria and/or business-related behaviours as laid down by MP Birla Cement from time to time.

8.  ‘Rewards’ are the gifts offered by MP Birla Cement, from time to time at its sole discretion, to members of the Akanksha program against redemption of points earned by them.

9.  ‘Bonus Points’ mean additional points which will be credited to the members under specific circumstances. These may be occasion specific or variable bonuses as specified by MP Birla Cement for a specific scheme or occasion.

10. ‘Helpdesk or Helpline’ means the member service centre for resolving members’ queries in connection with or related to Akanksha only.

11. ‘Retro-Credit/Debit’ means facilitating the credit/debit of points to members based on booked purchases/returns shown to have been booked but not accounted for in the point statement.

12. ‘Points’ means the points earned by a member of Akanksha for the business influenced and advocated by the member for MP Birla Cement.

13. ‘Member ID’ means unique registered mobile number (RMN) of the Technocrat enrolling as members for the ‘Akanksha’ program during the registration process.

14. ‘Service Partners’ shall mean the implementation agencies and other in-house or contract service providers.

15. ‘Ongoing Program’ means the program validity is on-going. It is a long-term initiative by MP Birla Cement. However, membership criteria and benchmarks shall be revised and updated from time to time, during the tenure of the program.

Eligibility and Membership:

Rewards and Benefits:

1.  All members who are enrolled into the Akanksha program by MP Birla Cement are entitled to earn points which can be redeemed for rewards that will be sent to the members in accordance with the terms and conditions for redemption specified under Akanksha Programme.

2.  All rewards related communication will be mailed to the mailing address or emailed to the email address as specified in the enrolment form by the Technocrats while registering into the program or subsequently updated thereafter on the digital profile page.

3.  Points issued in the MP Birla Cement Akanksha program have no monetary value and cannot be sold, transferred and/or exchanged by members in any manner at any point of time or be redeemed for cash. These points may only be exchanged for rewards on offer through Akanksha program.

4.  The points earned by members are valid till members are dealing with MP Birla Cement.

5.  No purchase/sale/transfer of points or benefits is permitted. The member can only earn points as per the conditions specified in the program.

6.  TDS or any other tax, wherever applicable, will be borne by the recipient of the rewards.

7.  Rewards and benefits will be delivered to the member’s address only and not to any other address.

8.  No cash top-up or cash reimbursement for points or benefits will be given at any point of time.

9.  All members will get to see points earned/accrued/redeemed in the program’s digital interface and receive communication from time to time.

10. In case of death of a member, the membership will automatically lapse, and no benefits will accrue to any other individual(s).

11. In case of cessation of the Member, membership will expire and not be inherited by any family member (surviving, heirs or like).

12. Selection of rewards and benefits is and will be at the sole discretion of MP Birla Cement. They are liable to change without notice.

13. MP Birla Cement holds out no warranty and makes no representation (whether expressed or implied) about the goods and / or services, manufactured / supplied by third parties that are offered as benefits to members of the program, particularly with regard to their quality or suitability for any purpose. MP Birla Cement shall not be liable if the said goods / services are defective / deficient/inefficient or like, in any manner whatsoever.

14. MP Birla Cement shall not be held responsible for any delays in delivery of the benefits.

15. MP Birla Cement will not be responsible for benefits that are stolen, damaged, destroyed, deteriorated in quality or lost in transit before delivery to the member.

16. All benefits offered by MP Birla Cement are on a best effort basis. In case a member is not offered a particular benefit or if MP Birla Cement does not make a particular benefit available, MP Birla Cement will not be liable to make good or compensate for the same in any manner whatsoever.

General:

1.  MP Birla Cement reserves the right to withhold benefits or terminate the membership of a member if any member breaches the terms and conditions of this program. Upon such termination, all benefits standing to the credit of the member shall be lost without the member being entitled for any compensation therefore and the member shall be barred from future membership.

2.  The program does not have any pre-determined date of termination and shall be in force until MP Birla Cement at its sole discretion terminates the program.

3.  MP Birla Cement reserves the right to add, modify, delete or otherwise change the terms and conditions, without prior notification to members

4.  The program and any benefits, offering or the like relating to the program shall not constitute or deem to constitute a contract or otherwise establish a contractual relationship between MP Birla Cement and any member.

5.  Nothing contained herein is intended to or shall be construed as creating or establishing any agency, partnership or joint venture relationship between MP Birla Cement and the member or service partners.

6.  Member(s) shall be responsible for awareness and updating themselves of the program rules and their entitlements and availment.

7.  All communication and benefits shall be sent by mail, email, tele-call or handed over to members at the address/email id/mobile phone number mentioned in the Akanksha Program Enrolment Form created by MP Birla Cement.

8.  MP Birla Cement and / or its service partners shall not be liable for the failure of any communication to reach the member, it shall be the responsibility for the member to inform MP Birla Cement about any change in address/phone numbers and MP Birla Cement bears no responsibility for communication lost or not received.

9.  All physical communication will be deemed to have been received by the member within 10 days of dispatch of the communication and on real-time for electronic communication. All communication by the member to MP Birla Cement shall be deemed to have been received on actual receipt.

10. In the event of dispute in connection with the program and the interpretation of these terms and conditions, MP Birla Cement’s decision shall be final and binding. The program shall be governed by the laws of India and all disputes will be subject to the exclusive jurisdiction of courts in Kolkata only.

11. The terms and conditions printed herein, in English language, is binding upon All members under the Akanksha Programme only and in case of any dispute this will be final and binding and will prevail over the terms and conditions printed in any other language.

12. MP Birla Cement makes no representation or warranty other than those specifically set forth in the above terms and conditions.

13. The members hereby undertake to indemnify and hold harmless the MP Birla Cement, its directors and its employees from any direct or indirect claim, damage, loss economic or otherwise made by or through them or by any third party with reference to the above terms and conditions.

14. MP Birla Cement shall not be liable to you or to any other person for any disruption in access or intermittent access or failure to access the digital portal or for any network or hardware failures (or loss of data resulting from such failure).

15. Force Majeure: The MP Birla Cement shall be released from their obligations in the event of any act of God, national emergency, war prohibitive Governmental Regulations, labour strike, any network or hardware failures (or loss of data resulting from such failure) or any other cause beyond their reasonable control which renders the performance of the Terms and Conditions as stated herein impossible or unlawful for them.
